Добровольческие вооруженные формирования, создаваемые в штатах, входят в состав Сухопутных войск и ВВС. Конституция США предусматривает разделение обязанностей властей штата и федеральных властей: первые набирают солдат и офицеров, а вторые вооружают их и управляют формированиями. В современной форме Национальная гвардия создана по закону Дика 1903 [Dick Act of 1903]. По Закону о национальной обороне 1916 [National Defense Act of 1916] стала независимым подразделением Сухопутных войск США [ Army, U.S.] наряду с регулярной армией и резервом. В 1947 была создана Национальная гвардия ВВС [Air National Guard]. Национальные гвардейцы должны проходить курс тренировки продолжительностью не менее шести месяцев. В некоторых штатах губернатор штата является главнокомандующим гвардией штата и может созывать ее при возникновении чрезвычайных обстоятельств: при наводнениях, пожарах, в случае беспорядков и т.д. Бойцы Национальной гвардии в любой момент могут быть мобилизованы на федеральную службу, как это было во время войн и в период Берлинского кризиса 1961. Расовые беспорядки и волнения среди студентов в 1960-70-х также приводили к мобилизации Национальной гвардии под федеральным командованием. Во время войны в Персидском заливе [ Gulf War] на действительную службу были призваны 72 тыс. резервистов Национальной гвардии - рекордное количество со времени войны в Корее [ Korean War].
